초록

[한글]2002年은 韓·中 修交(1992.8) 10週年이 되는 해이다. 10年間의 韓·中 雙務經濟貿易 協力關係는 迅速한 發展을 해왔고 韓·中 兩國은 이미 서로의 重要한 貿易 및 投資協力 對象國이 되었으며 中國이 WTO에 加入(2001. 11)함으로 國際的 經濟 흐름에 積極的으로 合流하였고 世界經濟가 中國 市場 進出을 위해 拍車를 가하고 있다. / 이와함께 우리 企業들의 中國進出이 增加함에 따라 우리 商標의 中國內 認知度가 높아지고 그에 따라 韓·中 兩國 企業間의 商標紛爭이 頻發하고 있다. / 海外에서의 知的財産權 侵害 中에 商標權의 侵害가 가장 많이 發生하고 있는데 그 理由는 商標權이 他 權利에 비해 他人에 의한 模倣이나 盜用이 相對的으로 容易하기 때문이다. 地域的으로는 中國圈(中國, 香港, 臺灣) 地域에서 侵害가 가장 많이 發生하고 있다. 앞으로도 韓·中 兩國間의 商標紛爭이 增加할 것으로 豫想된다. 이러한 商標紛爭에서 철저한 商標管理 없이는 새로운 通商體制下에서 生存하기 힘들 것이다./ 本 論文에서 이러한 韓·中間의 商標紛爭을 解決하기 위하여 우리企業들의 對應方案을 다음과 같이 提示하였다./첫째, 우리 企業들은 中國의 政治, 經濟, 文化, 法體制 등의 綜合的인 理解 를 통해 中國市場에서 失敗의 危險性을 줄여야 한다./둘째, 中國語가 英語와는 달리 "表意 文字 言語" 라는 言語學的 次元의 特 徵을 살려 브랜드 네이밍을 하여야 한다. /셋째, 中國商標制度를 理解하고 우리 商標法과 相異한점 또는 改正法등을 熟知하여 우리 商標權의 法律的 保護에 努力하여야 한다./넷째, 우리 企業들은 中國 進出時에 商標의 出願, 登錄, 權利維持, 紛爭 등 의 總括的이고 體系的인 商標管理가 必要하다./다섯째, 中國 關聯 商標專門家를 養性하여 商標紛爭에 적절히 對處하여야 한다./여섯째, 韓·中 兩國間 政府次元의 知的財産權에 관한 交流와 協力을 통 하여 知的財産權 保護政策을 强化하여야 한다./ 結論的으로, 이상과 같이 우리 企業들이 中國企業과의 商標紛爭에 있어 法的 對應과 事前 豫防을 할 수 있도록 商標權에 대한 認識이 새로워지는 契機가 되고 나아가 韓·中 兩國의 安定的 成長과 發展的인 關係를 維持하는데 그 目的이 있다. ////

The year of 2002 is the one of the tenth anniversary of Korean-Chinese Amity since its agreement between the two countries. For the past 10 years, relations of the cooperation of bilateral, economy and trade between the two countries have rapidly developed; therefore these two countries became already a close trade partner each other for their important trade and cooperation of investment; with China''s joining WTO(Nov., 2001), it was positively merged into a flow of international economy; and now world economy spurs itself to advance into the Chinese market./ Also, with increasing of Korean enterprises'' advancement into China, Korean brands came to be widely recognized in China; and thereby disputes of the brand between the two countries occur frequently./ Piracy of the trademark, or trademark infringement occurs most frequently in the infringement of intellectual property rights overseas; and its reason is that imitation of the trademark right or using it by stealth is relatively easier, in comparison with other rights. Regionally, it occurs mostly in the area of China bloc(China, Hong Kong and Taiwan). In the future, it is anticipated that disputes of the trademark or brand will increase. Without thorough control of the trademark or brand in trouble of it, it would be so difficult for a country to survive./ The purpose of this study is to provide some countermeasures in order to settle disputes of the trademark or brand between Korea and China so that these two countries can maintain stable, economic growth and relations of mutual development./ Based on this study, some countermeasures in settling disputes of the trademark or brand between the two countries are suggested as follows:/ First, it is suggested that our Korean enterprises should decrease the risk of failure in the Chinese market through synthetically understanding of politics, economy, culture, the law system in China. / Second, it is suggested that the trademark or brand should be named in consideration of some linguistical features of Chinese since Chinese is a language of "semantic symbols" different from English./ Third, it is suggested that efforts should be given to legally protecting our trademark or brand rights through understanding well of the Chinese brand system, and also through being well aware of some different points or revised laws, etc. in the Chinese brand law with our brand law./ Fourth, it is suggested that when our enterprises enter into the Chinese market, overall and systematic control or management of the brand is needed in application, registration, maintenance of the brand right, disputes of the brand right, etc./ Fifth, it is suggested that with many specialists of the China-related brand being trained and produced, our country Korea should properly cope with or manage disputes of the brand right./ Sixth, it is suggested that the policy of protecting the intellectual property rights should be reinforced through exchange and cooperation regarding the intellectual property rights in a `government'' dimension between Korea and China. / In conclusion, this study has focussed on giving a chance for Korean enterprises to make it anew to recognize and understand the brand right so that their legal countermeasure and prevention of the brand right in advance in disputes of the brand right between Korea and China can be well done in order that stable, economic growth and relations of mutual development between the two countries should be maintained./
